You have there the famous Marx 'Sparkling Tank'. A model based on an earlier design originally added to a Military tank transporter railway set. Many versions of the 'Sparkling Tank' were made with different litho designs. Does yours have the flip-over mechanism underneath, looks late enough to be of that type.
Marx were big on toy Tanks with prototypical and fictional models in their product line up and yours was a very popular addition to the range a great little toy with hours of fun for the owner!

yes it has the flip over. It lacks the energy to put it into full motion though! What you say 40's or even 50's?

The original Military version dates from the late 1930's, and does not have the flip-over action, it is just plain so it can sit correctly on the train's transporting car. I would say yours is from the 1950's. Someone with an extensive Marx collection could give a more accurate date by the logo on the back of the Tank. Yours does have the early 1950's, 'MAR TOYS' logo (toys with this logo are often called 'Mar Toys' because the 'X' is just not noticed!). It also came in a cardboard box with the basic interlocking end-flaps, again a 1950's design.
