Bad buyer warning!

Bad buyer WARNING! Buyer filed false "item not received" claim with and I was debited the sale price and postage cost. USPS tracking indicated "item received" buy the buyer. They now have my very near mint M8 Mobil Gas Tanker and the money and the postage fee.

How can the buyer file a claim whilst item is in transit and they debit you. I would seriously demand legal proceedings against Ebay/Paypal for this breach especially when shown as delivered as this is out and out fraud by all parties involved except yourself. No matter what it cost I would seek legal advice to reclaim your money plus your costs over and above for legalities.
This sort of thing gets right up my nose and I wouldn't just ignore it and leave at this Joe.

Worst of all is that the buyer refuses to respond to direct emails or emails sent via the auction provider. The buyer is the biggest problem here and I maintain my claims about them being dishonest.

I have contacted the auction provider and a review of the "case" is "pending." Most of these features are automated and now a human being from the auction will have to get involved.
It might be time to start my "Bucket List."

Update on this Bad buyer: He's still out there buying away and has purchased other items this month. He has not responded to any (zero response) of my emails through ebay or directly.

I phoned up ebay about this issue. Their first response was that I failed to send ebay the items tracking number when the buyer first claimed "item not received." I told them that was an untrue statement and forwarded them a screen capture shot of the form I filled out, clearly showing a valid tracking number. Then I directed them to look at the tracking number which showed the item had been delivered and sent copies of all my attempts to contact the buyer.

The ebay representative put me on hold and looked at the information. they came back and told me that they would issue me a "one time credit for this item" and put the money back in my paypal account. My response was why should I receive some special exception "one time refund" when:
Clearly I had shipped the item with a tracking number.
That at the time of the complaint the tracking information showed the item "in transit."
That the tracking number now shows the item as "delivered to recipient."

I was quite irritated by the whole event and said I would only accept a complete reversal of their decision in my favor (since I had clearly and concisely followed all of ebay's rules and that the buyer had not done so) or that I would pursue another course of action. I was put back on hold.

After a few minutes, the rep came back on the line and told me that ebay had reversed it's decision and the money would be put back into my account. I don't know if ebay debited the seller and I wonder if the seller just "got away with it." Chances are that they did.

The buyers total refusal to communicate shows their intent to defraud and I hope those here whom are sellers have added this person to their blocked bidders list.

It really is shambolic that when you have clearly followed the rules Joe and when all the information was available to the buyer that the item was in transit that Ebay decided in the buyers favour. There is something fundementally wrong with e bays buyer protection rules when it can be so easily abused. Not only was this buyer at fault, Ebay have a major part to play to.

I admire your persistance Joe when dealing with the issue in your communications with ebay and the end result was the correct one. It is very unfortunate that you had to waste time making phone calls and incur associated costs as a result.

This has happened to me before with a PlayStation I sold on there. Buyer files a claim, eBay refund the buyer. I complain, and get my money back too!

eBay is too heavily weighted in favour of buyers these days. Sellers have to most of the time put up or go elsewhere.

I agree. There is an awful lot wrong with Ebay but, in spite of that, no one seems to be able to make a significant dent in their share of the online Worldwide auction market. (Actually, that's a lot like Windows: a product many people hate but which maintains market dominance.)
